registering a business name

here is the story.

2 months or so ago, my partner and I split up. We have been using the same insurance <policy> is primary in her name as well as the bonding. I came up with our business name 2 1/2 yrs ago when I was toying with the idea of starting a cleaning company. I plan on getting insurance and bonding in my name within the next month and I want to keep the business name. Can you suggest and resources where I can protect the name in case she doesnt surrender it?

Did either of you register the name with your county/state recorders office and file a DBA?

I called the county I live and work in and they stated that It would be $14.00 but they said it wouldnt guarantee someone else using it. How do I file a DBA?

Here is California we file a DBA (doing business as) at the country recorders office. Then we have to post a notice in the paper for 3 weeks to announce our intent to use that name. We then have to go to our local (city) business office and apply for a business license.

You might also be able to register the name online. I did a LLC a while back - completely online. I think it was about $50. Depends on the state of course.

You will need a Trademark or Service mark to protect the name and be able to prove first use too your local trademark office or the the feds.
