As we began to plan for expansion, the issue of expanding the business using independent contractors vs employees got right in our face.

Research showed this to be a thorny issue with some dangerous pitfalls either way.

We're currently leaning toward employees because the issue is so vague, and because all agencies involved, from the IRS to state labor and industries, can arbitrarily choose to rule your contractors employees, a ruling that is retroactive and can include back taxes, penalties and interest. That could kill a young, underfunded business like ours.

What are you doing, and what led you to the decision you made?

Resource for Independent Contractor issues

BTW, I found "Working with independent contractors by StephenFishman (www.nolo.com) very useful for understanding the core legal issues around independent contractor vs employee.

Oblio, I am looking at the same issues. My intentions are to use a temp service to start with and hope to find trustworthy employee's in the process. I think I will steer away from the contractor issues myself. Babysteps!

Using temps for cleaners

Up until now my partner has been the only cleaner the customers know, and trust. They are all fond of her, so getting them used to someone else may be an issue.

We would rather find someone to hire and train before introducing them to the customers as their full-time cleaner. It seems to me that trust is a core issue for the home cleaning business, maybe even more important than the quality of the cleaning.

Trust is based, I think, on consistency. The less churn of cleaners the better.

But all this may be easier said than done.
